MIAMI BEACH, FL – The tranquility of an evening stroll along the sand was shattered earlier this week when an unsuspecting man was brutally attacked near a lifeguard tower on Miami Beach’s bustling Collins Avenue. Police say a request for a cigarette and a chance to borrow a cellphone ended in a near-fatal confrontation, leaving the community shaken and a suspect behind bars.
The incident unfolded on the night of October 23, 2025. According to investigators, a man chose a quiet spot by the shore to rest, unaware of the danger about to unfold. Within moments, Jack Daniel Gutierrez, 24, approached the victim, first seeking a cigarette. After being told the man did not smoke, Gutierrez then asked to use his cellphone. He was once again denied.
What seemed like a mundane encounter quickly turned harrowing. Authorities said the victim believed Gutierrez had left the scene, but was instead ambushed without warning. Police allege Gutierrez returned, wielding a knife or similar blade, slashing the victim across the neck in a violent and sudden attack.
Disoriented and bleeding profusely from a deep wound stretching from ear to ear, the victim managed to activate a hands-free emergency call using his phone’s voice assistant. Emergency responders arrived within minutes, finding the man severely injured but conscious. He was rushed to a nearby hospital, where he received urgent medical care. Officials have not yet updated his condition.
Within days of the stabbing, investigators intensified their search for Gutierrez. The victim, despite his injuries, was later able to identify his attacker from a photo lineup—an act that proved crucial in the police investigation.
