Florida Man Sues Dunkin’ Donuts for $50,000 After Explosion-Covered in Feces and Urine

WINTER PARK, Florida – A man from Flagler County, Florida, is suing Dunkin’ Donuts for $50,000 after claiming that a toilet at one of its locations in Winter Park exploded on him, covering him in feces and urine. According to the court filing, the plaintiff, Paul Kerouac, is seeking damages for “sustained severe and long-term injuries” following the traumatic incident on January 6, 2022.

In the lawsuit filed against Dunkin’ franchisee HZ O Donuts LLC, Kerouac alleges that the franchisee was negligent in maintaining the men’s room and the toilet in a safe condition. He claims that prior incidents with the toilet had occurred and store workers were aware of the problem.

The plaintiff is seeking at least $50,000 in damages, as well as prejudgment and post-judgment interest, costs of actions, and a trial by jury. His attorney, Scott W. Spradley, stated that Kerouac has suffered bodily injury, psychological damages, mental anguish, and a need for mental health care as a result of the trauma experienced in the restroom.

The lawsuit alleges that the franchisee failed to warn about the dangerous condition of the toilet, creating a hazardous situation for the public, including Kerouac. It also claims that the franchisee failed to inspect the men’s toilet and neglected to warn customers about the potential danger.

A request for comment from Dunkin’ Donuts did not receive a response before publication.
