Suspect Charged with First-Degree Murder and Aggravated Eluding in Death of Deputy Sheriff after Intense Police Chase

SIOUX FALLS, South Dakota – South Dakota prosecutors charged a Sioux Falls man with first-degree murder and aggravated eluding on Monday after he caused the death of Moody County Chief Deputy Ken Prorok during a police chase. The incident occurred when the deputy was struck while deploying spikes on the road to stop the suspect’s car.

Court documents revealed that Joseph Gene Hoek, 40, was experiencing a drug-related episode and escalating threats before the tragic event. According to Special Agent Jeffrey Kollars of the South Dakota Division of Criminal Investigation, people close to Hoek described a downward spiral marked by drug use and escalating threats of violence.

At his first court appearance, Hoek was ordered to be held without bail in connection with Prorok’s death. South Dakota Attorney General Marty Jackley is personally prosecuting the case and is considering whether to seek the death penalty.

Prorok died at the scene of the pursuit after being struck by the car driven by Hoek, who fled on foot but was soon detained by a witness. Kollars also mentioned that investigators found THC vapes, marijuana paraphernalia, and other controlled substances in Hoek’s car.

Hoek’s attorney, Manuel De Castro, suggested that his client may have mental health issues that need to be explored. However, the attorney acknowledged the emotional nature of the case and stated they would gather more information before proceeding.
