Wharton County Mother Receives 45-Year Sentence for Toddler’s Murder

WHARTON COUNTY, Texas – A Wharton County mother has been sentenced to 45 years in prison for the murder of her 2-year-old son, who suffered severe head trauma and injuries all over his body, according to the Wharton County Sheriff’s Office. Rebecca Lynn Hart, who was initially charged with capital murder, pleaded guilty to murder and waived her right to an appeal before her sentencing.

The victim, Daniel Escamia, had endured continuous physical abuse, according to the Texas Department of Family and Protective Services’ child fatality report. The report stated that on the day he died, the toddler had unexplained injuries all over his body, had not been fed, and was forced to sleep in a closet by himself in his filthy home near El Campo.

The sentencing has left some family members feeling unsatisfied, with Daniel’s great-aunt expressing that she believed Hart got off easy. Hart will be eligible for parole in 22.5 years, leaving some family members feeling that justice was not fully served.

Wharton County First Assistant District Attorney Mark Racer stated that while he understands the family’s position, they wanted to resolve the case. He believes that the sentencing was a just result and that Hart will spend a significant amount of time in prison.

Daniel’s father, Eddie Escamia, was also charged with endangerment of a child with bodily injury. His case is still pending.
