Texas 10-Year-Old Confesses to Fatal Shooting of Man in Sleep: Sheriff’s Office

Nixon, Texas – A 10-year-old boy in Nixon, Texas has confessed to fatally shooting a man in his sleep two years ago, according to the Gonzales County Sheriff’s Office. The incident occurred at the Lazy J RV Park, located in Nixon, Texas, about 60 miles east of San Antonio.

Brandon O’Quinn Rasberry, 32, was found dead in his RV on Jan. 18, 2022, with an autopsy revealing he was shot once in the head, ruling his death a homicide. The Sheriff’s Office was notified of the child’s involvement in the shooting on April 12, after a report was made by a principal at the Nixon Smiley Independent School District.

Upon investigation, it was revealed that the child had made a statement at the school claiming he had shot and killed a man two years prior. The boy was subsequently taken to a child advocacy center for an interview, during which he provided details of Rasberry’s murder.

The child recounted how he had taken a 9mm pistol from his grandfather’s truck, entered Rasberry’s RV, and shot him in his sleep before fleeing the scene. Despite not knowing Rasberry personally, the child claimed he had observed him around the RV earlier in the day of the incident.

While investigators were able to trace the weapon used in the murder to a pawn shop in Seguin, Texas, no murder charges were filed against the child due to Texas law stating that criminal culpability does not apply to children under ten years old. The boy was placed in psychiatric care for evaluation and treatment following the incident.

Awaiting his court date in custody at Gonzales County, the child faces a terroristic threat charge from the school bus incident. Details surrounding the case are still developing as authorities continue their investigation into the tragic event.
