Kyle Man Sentenced to 65 Years in Prison for Brutal Assault on Girlfriend Amid Children’s Terrifying Witness

Kyle, Texas – A local man was sentenced to 65 years in prison following a conviction for a violent assault against his girlfriend, which occurred in the presence of their children. This case underscores the severity of domestic violence, according to Hays County officials who announced the sentence on Friday.

Andy Wayne Carty faced charges of aggravated assault with a deadly weapon in a family violence context, as well as other offenses, including continuous family violence and violating a protective order. The jury’s decision also included five-year concurrent sentences for lesser charges associated with the case, but Carty must serve at least 30 years before he is eligible for parole on the more serious assault conviction.

Prosecutors described a disturbing pattern of escalating violence throughout early 2023. Testimony revealed that a heated argument within the home escalated to physical violence, leaving the victim with visible injuries. In one instance, Carty attacked the woman, slamming her against a wall while their daughters watched. One child attempted to call 911, but Carty intercepted the phone, preventing the family from seeking immediate help. They eventually managed to lock themselves in a vehicle in the garage and reach out to law enforcement.

Carty was initially arrested but released on bail shortly thereafter. Prosecutors revealed that the situation deteriorated significantly weeks later when he broke into the family home during the night. Evidence presented during the trial indicated that he had hidden electronic devices used to contact emergency services before confronting the victim in her bedroom, where one of their children was also present.

During this incident, the woman fought valiantly to protect her children against the prolonged attack, suffering severe injuries in the process. The physical confrontation moved throughout the house as the children attempted to intervene. Ultimately, they fled to a neighbor’s residence, with their mother following after managing to escape Carty’s grasp.

Emergency responders, including a SWAT team, arrived at the scene, and the woman was promptly taken for medical care. Despite Carty’s attempts to elude capture, he was apprehended shortly afterward following a brief search.

Prosecutor Jon English commended the bravery of the victim and her children, stating that their actions, along with the dedication of local law enforcement, played a crucial role in achieving justice. “Their courage, along with the commitment of the Kyle Police Department, inspires our ongoing battle against domestic violence,” he noted.

Following a two-week trial beginning on February 3, Judge Joe Pool presided over the proceedings, which highlighted the serious consequences faced by perpetrators of domestic violence. Prosecutor Claudia Garcia emphasized the jury’s sentence as a strong message against such offenses, asserting that individuals like Carty will be held accountable for their actions.
